Terms of Use for FridgeApp.ai

Overview

These Terms govern your use of the FridgeApp.ai service and application (“Service”), operated by Andrzej Litwiński Consulting (ALC), ul. Akacjowa 42c, 55‑093 Kiełczów, Poland, VAT ID 898 202 47 84 (“ALC”).

By using the Service, you agree to these Terms, our Privacy Policy, and our Cookies Policy (including CMP settings).

The Service is available to consumers worldwide, subject to mandatory consumer protection laws applicable to you.

Account and registration

You must provide accurate, complete, and up‑to‑date information and safeguard your login credentials.

ALC may suspend or terminate access in case of abuse, unlawful use, or breach of these Terms.

Plans, test phase and transition to paid subscriptions

We offer two plans: FREE and PREMIUM, as described on the website.

During the test phase, both plans are free of charge. After tests, we plan to launch paid PREMIUM and a 7‑day trial.

PREMIUM accounts created during tests may be converted to FREE after the tests unless you choose a paid subscription. We will notify users at least 14 days in advance (email/in‑app notice).

Subscriptions, payments, pricing (post‑launch)

• PREMIUM will be billed on a subscription basis: monthly or annually, prepaid for each billing period, with auto‑renewal until you cancel.
• Prices may be displayed and charged in your local currency (subject to availability, FX, and payment provider/card issuer rules). Planned payment provider: PayU (ALC may change/add providers).
• We will announce price or subscription changes at least 14 days in advance; they apply to the next billing period.
• Cancellation: you can cancel anytime, taking effect at the end of the current period; PREMIUM features remain available until the end of the paid term.
• Refunds: no refunds for started billing periods, except where mandatory consumer laws require otherwise.

Right of withdrawal (EU)

EU consumers have 14 days to withdraw from distance contracts unless the digital service begins before the end of this period upon the consumer’s express request and acknowledgment of losing the withdrawal right. Mandatory law applies.

To withdraw, email andrzej@fridgeapp.ai. Any due refunds will be processed promptly, within 14 days, using the original payment method unless otherwise agreed.

Acceptable use and license

• We grant a non‑exclusive, non‑transferable, revocable license for personal use in accordance with these Terms and applicable laws.
• Prohibited: decompilation, reverse engineering, circumvention of security, automated scraping/load testing without consent, unlawful or third‑party‑rights‑infringing use.

User content and data

You retain rights to your content. You grant ALC a non‑exclusive license to store, process, and display it solely to provide the Service and technical support.

Privacy and cookies (CookieYes and Microsoft Clarity)

• Personal data is processed per our Privacy Policy. We use cookies and similar technologies per our Cookies Policy and your choices in the CMP banner.
• Analytics tools (e.g., Microsoft Clarity) run only after obtaining appropriate consent (e.g., ePrivacy/GDPR in the EU). You can change your cookie choices at any time via the “Cookie settings” link.

Availability and maintenance

We will use reasonable efforts to provide availability; however, maintenance windows, updates, and outages may occur. Uninterrupted operation is not guaranteed.

Liability

To the maximum extent permitted by law, we are not liable for lost profits, indirect, or special damages. ALC’s total liability to you is limited to fees paid by you in the 12 months preceding the event, excluding willful misconduct and liability that cannot be excluded (including death or personal injury). This does not limit consumer rights.

Complaints and ADR/ODR

• Submit complaints to andrzej@fridgeapp.ai. We will respond without undue delay, no later than 14 business days, via email.
• EU consumers may use Alternative Dispute Resolution (ADR) and the EU ODR platform. Participation is voluntary.

Termination and data

• ALC may suspend or terminate the Service/account for material breaches or abuse. You may delete your account at any time.
• After termination, we may retain data for billing, security, and legal obligations; see our Privacy Policy.

Governing law and jurisdiction

These Terms are governed by Polish law. Disputes shall be resolved by Polish courts competent for ALC’s seat, subject to mandatory consumer protection laws and jurisdiction of the consumer’s residence where applicable.

Changes to Terms

We will notify you of material changes at least 14 days in advance (email/in‑app notice) with the effective date. Continued use after that date constitutes acceptance. If you do not agree, you may terminate before changes take effect.
